    Collective agreement required employer to pay two premiums – lead flight attendant premium: 15% of base salary – draft premium: 50% of base salary when called to non-scheduled work – employer stacked premiums to calculate draft until January 2016 – began calculating lead and draft premiums separately – union grieved – employer is not required to stacked premiums when calculating draft – past practice, however, created legitimate expectation for union – employer required to pay stacked premiums
  • Human Rights – Pedroso v Air Canada – 2020 FC 464
    Judicial review of Canadian Human Rights Commission decision to dismiss complaint – applicant alleges discrimination based on his age – applicant applied to work as a flight attendant – he was 60 years old – worked as an airplane groomer – passed all stages of hiring process except in-person interview – question before court was whether Commission had conducted a fair investigation – Commission had – examination of Air Canada’s procedures and interview results did not disclose grounds of discrimination
  • Property – Specter Aviation c Laprade – 2020 QCCS 1060
    Laprade contested seizure pending judgment of Beechcraft Super King Air 300 – Specter claimed it was the true proprietor of the aircraft – party requesting seizure must always prima facie show that aircraft was improperly acquired – aircraft seized during contract negotiations – Laprade thought contract concluded, seized aircraft in secret – other parties had not consented to transfer of ownership – prima facie case met – seizure pending judgment continued
  • Free lunches – Air Canada v Sorella – 2020 CanLII 25179 (CA SA)
    Employee terminated for eating free lunches at Dorval cafeteria; breach of trust – Head of service at Air Canada’s property section – responsible for food services – employee contested termination – admitted facts, submitted that termination was too harsh a penalty – termination warranted: breach of trust too severe to reconstruct employment relationship
