    Former AME claimed Union acted in breach of its duty of fair representation – Employee was terminated and not reinstated under grievance process due to failure to accommodate his disabilities in AME position – Complainant stated Union failed to disclose offer to settle, refused to pursue several grievances at time of termination grievance thereby breaching its duty under s. 12 of the Labour Relations Code – Complaint dismissed as internal Union appeal process not exhausted before Complaint made to LRB and merits of Complaint not supported – Dismissed
  • Appeal – Second Injury and Enhancement Fund (SIEF) Relief – Decision No. 1822/18, 2018 ONWSIAT 2557
    Ramp attendant injured on aircraft stairs, then further injured shoulder in non-occupational accident – Employer sought SIEF Relief – Basis of SIEF Relief is pre-existing condition that is impacted by occupational accident that prolongs absence and recovery – Employee did not have pre-existing condition as non-occupational injury occurred after the workplace accident – Appeal dismissed
