Ontario Government Creates Process for Workplace Safety and Insurance Board to Collect Overpayments for Infectious Disease Emergency Leave

As discussed in a previous Focus Alert, employees needing to take leave for specified reasons relating to COVID-19 may be entitled to Infectious Disease Emergency Leave (IDEL), which provides for up to three paid calendar days of leave, with a maximum payment of $200 per day.   The COVID-19 Worker Income Protection Benefit, administered by the Workplace Safety and Insurance Board (WSIB), reimburses employers for amounts paid to employees for IDEL. Chief Medical Officer of Health Issues COVID-19 Vaccination Policy Instructions for Select Sectors

As discussed in a previous Focus Alert, on August 24, 2021, the Ontario government filed a regulation requiring businesses and organizations to operate in compliance with any advice, recommendations and instructions issued by the Office of the Chief Medical Officer of Health (CMOH): requiring the business or organization to establish, implement and ensure compliance with a COVID-19 vaccination policy; or setting out the precautions and procedures that the business or organization must include in its COVID-19 vaccination policy. Ottawa Public Health Releases Workplace Vaccination Policy Guide

On September 2, 2021, Ottawa Public Health (OPH) announced the release of A Guide on How to Create a Workplace Vaccination Policy (the “Guide”), revised on September 13, 2021.  There have been recent and rapid developments regarding mandatory vaccination policies in particular sectors.  The Ontario government also recently announced a mandatory vaccination requirement for people to access certain settings and businesses, but that regime does not apply to employees.  This guidance may therefore be of assistance to employers who are not covered by sector-specific mandatory requirements. Ontario Government Releases Regulations and Guidance in Support of Proof of Vaccination Requirement

Readers of Focus will recall that on September 1, 2021, the Ontario government announced that individuals will need to be fully vaccinated and provide proof of their vaccination status in order to access select settings and businesses effective September 22, 2021. On September 14, 2021, the Ontario government filed Regulation 645/21 (the “Regulation”) amending the Rules for Areas at Step 3 and at the Roadmap Exit Step to account for the new requirement.  The Regulation comes into force on September 22, 2021.  The Ontario government also released a guidance document (the “Guide”) on the requirement for businesses and organizations. New Ontario Amendment Requires Employers to Comply with Chief Medical Officer of Health on Vaccination Policies

On August 24, 2021, the Ontario government filed a regulation (O. Reg. 577/21) amending the Rules for Areas at Step 3 and at the Roadmap Exit Step regarding the establishment and implementation of vaccination policies by businesses and organizations. This amendment provides the Province with the necessary authority to require employers to have a vaccination policy and set out what must be included in such a policy, should they choose to do so.
