    Canada Transportation Agency (CTA) issued public statements suggesting airlines could provide passengers with vouchers rather than refunding monies passengers paid for tickets – Air Passenger Rights (APR), an advocacy group, commenced application for judicial review of Canada Transportation Agency’s statements – APR brought motion for an interlocutory order to remove CTA’s statements – APR failed to prove it “raised a serious issue” on the tripartite test for injunctive release, since CTA statements did not affect legal rights – motion dismissed.
  • Application, Civil Resolution Tribunal – Seghall v. All Nippon Airways Co., Ltd2020 BCCRT 587
    Applicant traveled on respondent airline – applicant claimed $4,500 for allegedly pilfered items and cash from checked luggage on-route – Airline carrier’s liability limited to “Montreal Convention” and the Canada Transportation Act, Air Passenger Protection Regulations – Neither form of liability engaged – Applicant unable to prove claimed items were missing from baggage – Application dismissed.
  • Grievance, Adjournment Request – Canadian Union of Public Employees, Air Canada Component v. Air Canada2020 CanLII 35454 (Nyman)
    Air Canada requested grievance hearing be adjourned – CUPE opposed the request – Air Canada requested adjournment on grounds that it was operating on significantly reduced capacity, and some witnesses lacked technological resources to participate in remote hearing – Arbitrator recognized incumbent on institutional parties and legal community to take reasonable steps to facilitate remote hearing – Arbitrator rejected Air Canada’s two arguments for adjournment – Request for adjournment denied.
