As the late Justice Echlin of the Ontario Superior Court of Justice once said, a single act of misconduct by an employee may not be enough to amount to just cause for discipline or termination; rather, the employer needs enough “bricks to constitute a just cause wall”. In an ever-changing legal landscape, how can you make sure your just cause wall is strong enough to withstand judicial or arbitral scrutiny?
