Coming into force on September 8, 2016, Bill 132, the Sexual Violence and Harassment Action Plan Act (Supporting Survivors and Challenging Sexual Violence and Harassment), 2016, amends the Occupational Health and Safety Act (OHSA) to introduce new and onerous requirements for Ontario employers.
In addition to updating workplace harassment policies, procedures and employee training, employers must now also ensure that proper investigations are conducted and reports are produced whenever an allegation of sexual harassment is made.
Employers should anticipate an increase in the number of investigations to be conducted, making it more important than ever to ensure that human resources practitioners, executives, corporate counsel and others responsible for human resources have the skills and knowledge they need to conduct quality investigations that will withstand scrutiny by arbitrators and the courts.
