While many organizations have moved to implement remote work arrangements as a result of the pandemic, not all jobs can be performed remotely, and employees providing essential services are still required to attend their workplace every day. Fear of contamination by COVID-19 and the reported shortage of PPE have led to a growing number of instances where these employees are refusing to work.

With limited exceptions, employees have a legal right to refuse unsafe work. Employee work refusals further challenge essential services providers’ staffing capacity already impacted by public health authority recommendations for physical distancing and self-quarantine in certain circumstances, and care obligations imposed on working parents as the result of school and daycare closures.
