My employee refuses to work until the pandemic is over – what can I do?

23 April, 2020 @ 11:00 am - 11:45 am

While many organizations have moved to implement remote work arrangements as a result of the pandemic, not all jobs can be performed remotely, and employees providing essential services are still required to attend their workplace every day. Fear of contamination by COVID-19 and the reported shortage of PPE have led to a growing number of instances where these employees are refusing to work.

With limited exceptions, employees have a legal right to refuse unsafe work. Employee work refusals further challenge essential services providers’ staffing capacity already impacted by public health authority recommendations for physical distancing and self-quarantine in certain circumstances, and care obligations imposed on working parents as the result of school and daycare closures.

Join J.D. Sharp and Neil Dzuba as they guide you through the process of managing work refusals in your workplace with the ultimate goal of keeping your employees at work. Learn about:

  • Addressing work refusals in the context of the pandemic
  • Your and your employee’s legal obligations
  • Limitations on the right to refuse unsafe work
  • What are your recourses
