Paid ESA Leave for COVID-19 Absences – Update on Entitlement and the Reimbursement Process

In late April, Bill 284 (the COVID-19 Putting Workers First Act, 2021) was passed into law. In particular, the Bill amended the Employment Standards Act so as to provide eligible employees with a new statutory entitlement to paid Infectious Disease Emergency Leave (IDEL), as well as to create a new COVID-19 Worker Income Protection Benefit program to reimburse employers for this expenditure. Despite their obvious public health benefit in the context of the ongoing pandemic, these recent changes are subject to stringent terms and conditions that can lead to confusion in practice. Employers whose employees may avail themselves of paid IDEL should therefore ensure that they properly understand the ins and outs of the amended legislation, even before they are required to make an application for reimbursement.
