  • Opening pleadings letter – Application by multiple applicants against Air Canada, WestJet, Air Transat A.T. Inc, United Airlines, Inc., Sunwing Airlines Inc. and Swoop IncLetter Decision No. LET-C-A-72-2020Multiple applications brought under the Air Passenger Protection Regulations alleging carriers were not meeting their obligation to accurately communicate the reasons for flight delays or cancellations – Inquiry Officer looked into matters raised by 567 applications related to 182 flights operated by the respondents – Inquiry Officer produced report highlighting several questions of interpretation regarding the proper categorization of flight disruptions, including questions concerning the definition of “scheduled maintenance” and the impact of disruptions to earlier flights on later flights, also know as “knock-on effects” – CTA agrees with the report’s suggestion that interpretive guidance would be beneficial – CTA opens pleadings on several questions of interpretation
  • Request for confidentiality – Application by multiple applicants against Air Canada, WestJet, Air Transat A.T. Inc, United Airlines, Inc., Sunwing Airlines Inc. and Swoop IncLetter Decision No. LET-C-A-71-2020Swoop and WestJet filed confidentiality requests with the CTA with respect to documents provided to the Inquiry Officer containing passenger names, passenger e-mail addresses, employee names, and employee identification numbers – CTA denies the carriers’ request for confidentiality in application alleging that Air Canada and WestJet had not communicated the reasons for flight disruptions in a way consistent with the requirements of the Air Passenger Protection Regulations
