  • Lost baggage – Thunderbolt v American Airlines Inc. – 2019 BCCRT 273
    Self-represented applicant requested reimbursement for lost baggage – American Airlines objected – respondent had passed limitation period in article 35 of Montreal Convention – applicant responded that she was disabled – Limitation Act applied to extend discoverability of claim – applicant’s claim dismissed – Montreal Convention supersedes local law

CIRB DECISIONS

  • Interim Certification – WestJet Encore Ltd. – Interim Order No. 11366-U
    Canadian Air Line Dispatchers Association applied for certification – WestJet disputes inclusion of 7 employees in bargaining unit because they have moved out of unit – Board certifies the bargaining unit – reserves jurisdiction to hear arguments regarding the 7 employees at issue – bargaining unit composed of:  
    all dispatchers employed by WestJet Encore Ltd.,  excluding  the Manager–Flight Dispatch, the Manager–Flight Technical & Ops and those above.
  • Certification Amendment – WestJet, an Alberta Partnership – Order No. 11360-U
    CUPE applied for certification of group of employees – Westjet and Swoop Airlines initially resisted inclusion of Onboard OPS Team-Cabin Crew Leader and Cabin Crew Manager in unit description – order deals with issue – includes positions in unit composed of:  
    all employees of WestJet, an Alberta Partnership employed as cabin crew members/flight attendants,  excluding  performance and support managers.
